In a surprising move, the legal team for Luigi Mangione, the alleged shooter of UnitedHealthcare CEO Brian Thompson, announced they would not pursue a psychiatric defense in Mangione's upcoming state murder trial. This decision was communicated to New York state Judge Gregory Carro on Thursday, just one day after Mangione's attorneys had indicated they might argue he was suffering from "extreme emotional disturbance" at the time of the incident on December 4, 2024.
The reversal comes as Mangione's lawyers faced a deadline to provide supporting information for their initial claim. In a letter to Judge Carro, attorney Karen Friedman Agnifilo stated the defense "respectfully withdraws" its notice under New York's psychiatric defense statute. The Manhattan district attorney's office, which is prosecuting the case, declined to comment on this development.
If Mangione's legal team had pursued the extreme emotional disturbance defense, it could have potentially reduced his charge from murder to manslaughter, which carries a maximum sentence of 25 years in prison. However, Mangione has pleaded not guilty to both state and federal charges, with his state trial set to commence on September 8 and his federal trial on October 13.
The decision to withdraw the psychiatric defense follows Judge Carro's order to unseal a transcript from a secret hearing held on June 3, where the defense had initially discussed the possibility of using the emotional disturbance claim. The judge emphasized the need for transparency, stating, "Nothing is going to be a surprise. I'm not going to let you surprise the prosecution on the eve of trial."
Mangione, a 28-year-old Ivy League graduate from a wealthy Maryland family, was arrested five days after the shooting in Altoona, Pennsylvania. Prosecutors have linked him to the crime using a 3D-printed pistol and a notebook found in his possession, which allegedly detailed his intent to target a health insurance executive.
As the trial approaches, Mangione's legal team will need to prepare an alternative defense strategy. The next state hearing is scheduled for August 11, with the trial expected to begin on September 8.
