Is It Constitutional To Be Fired For Your Personal Opinions?

With the recent rise in political violence that has culminated with the assassination of Charlie Kirk, inflammatory speech has seemingly hit an all time high. Many people have begun to lose their jobs over comments they made regarding the killing of the conservative commentator. Greg Giangrande, career advice expert, spoke with Mendte in the Morning about people being fired and the misconceptions around the First Amendment.

“Over the years I have often heard employees… mistakenly claim that they have freedom of speech and employers have no right to restrict or discipline them for what they say outside of work,” Giangrande told host Larry Mendte. “They’re just wrong on the laws and the facts… the First Amendment has absolutely no bearing on private employers.”

Giangrande explained why employers would care about the things you say on your personal time: “You are always a representative of the company, not just during work hours.”
