Suffolk County District Attorney Tom Spota is out on bail after being arrested on Wednesday.
He was charged with witness tampering and obstructing a federal investigation, in connection with the beating of a suspect by former Suffolk County Police Chief James Burke. Burke pleaded guilty to beating a man who allegedly broke into his vehicle and stole a duffel bag that contained sex toys.
Spota and an assistant are accused of trying to cover up the attack. He pleaded not guilty.
Spota previously announced he would not seek re-election. He’s been in office since 2002.
