Christopher Visone saw his personal injury lawsuit get tossed from the Manhattan Supreme Court today when Justice Barbara Jaffe ruled that he was to blame for a fall he took during the 2014 SantaCon. Justice Jaffe said, "Providers of alcohol owe no duty to protect against the consequences of one's own voluntary intoxication."
Visone, who fell backward down the steps of Kips Bay sports bar attempted to sue the establishment on the grounds they failed to keep the stairs clear. Visone who had a 0.34 blood alcohol level at the time of the fall was placed in a medically induced coma for several weeks while he received treatment for a traumatic brain injury.
Visone told the New York Post that "He's on five medications-including two that prevent seizures. He no longer drinks, and he's opposed to it (SantaCon) right now." Visone is appealing the court's ruling.
The NYPD made two arrests and issued over 50 summonses during this year's New York SantaCon.
