The Department of Justice intends to appeal last month’s decision to toss the documents case against President Donald Trump. Special Council Jack Smith filed an argument yesterday with the 11th Circuit Court of Appeals to reinstate the charges. Should Trump take this news seriously? According to Law and Crime Network anchor Jesse Weber, he should, but isn’t. Appearing on 710 WOR’s Len Berman and Michael Riedel in the Morning program, Weber opined that a win in November may be the only way to keep Trump out of the courtroom, or worse.
“I think this is going to take a while to resolve, not only months, maybe a year, maybe more,” Weber told Riedel and Larry Mendte, sitting in for Berman. “And again, Donald Trump’s best legal defense is to become the President of the United States. I said this all week as I was watching the DNC and everything- I said, I don’t understand; there are so many missed opportunities that Trump just didn’t take, and it’s almost as if he doesn’t realize that his whole life and livelihood should matter on him becoming President. That’s all he should care about.”
Still, Weber says the news of the dismissal is mostly good news for the Trump camp, if only for the fact that there won’t be a resolution any time soon. “Remember Judge [Aileen] Cannon, the Florida federal judge who dismissed this case, the idea here is that she dismissed it not because of the merits of the case, not that there wasn’t evidence there. She dismissed it because she said that Jack Smith didn’t have ... the authority to appoint him. Now, that decision is going to be reviewed by the 11th Circuit, an appellate court. I will tell you, I think there is a strong chance they’re going to overturn her opinion, and that they’re going to reinstate the case. This is not getting resolved before the election.”
