Decision Could Be Announced in Eric Garner Case

A decision is expected on Tuesday about whether civil rights charges will be brought in connection with the death of Eric Garner.

Garner’s family is set to meet with federal prosecutors in Brooklyn with a press conference to follow. Wednesday marks five years since Garner died, which is also the deadline to bring federal charges.

Officer Daniel Pantaleo is accused of using a banned chokehold on Garner on a Staten Island street corner in 2014. Video of the incident showed Garner repeatedly saying “I can’t breathe” as he was brought to the ground.

A grand jury declined to bring charges in the case.

An NYPD trial was held to determine Pantaleo’s future at the department. That has concluded and Police Commissioner James O’Neill is waiting for a recommendation about whether any disciplinary action should be taken.
